Complying with Your Homeland Security Obligations

ALL employers are required to complete and keep on file an I-9 employment Eligibility Verification form on every employee. ( ). This link is the current I-9 for use through April 2, 2009.

Use is mandated by the Department of Homeland Security at the time every employee’s employment begins. This one-page form contains one section to be filled in by the employee and one section to be filled in by the employer. The employer is required to verify that every employee has provided documents that establish his or her identity and the right to work in the United States using a list of documents that is attached to the form.

Failure to comply with Form I-9 requirements can make a business liable for up to $1,100 for each individual violation, and for more significant fines and potential criminal penalties if an employer knowingly hires and continues to employ unauthorized aliens. The existing form will be replaced with a new revision which must be used from April 3, 2009 on. (
